HB 1625 Summary

• Repeals previous smoking restriction sections (191.765-191.777) and establishes a comprehensive "Missouri Indoor Clean Air Act" (sections 191.1200-191.1230) effective January 1, 2015

• Prohibits smoking in all enclosed public places including bars, restaurants, health care facilities, educational facilities, gaming facilities, hotels (except up to 20% of rooms), shopping malls, sports arenas, theaters, and public transportation with no designated smoking areas allowed

• Prohibits smoking in all enclosed workplaces without exception and requires employers to communicate smoking prohibitions to existing and prospective employees

• Prohibits smoking within 15 feet of entrances, windows, and ventilation systems of smoke-free buildings, in outdoor arenas and stadiums, outdoor public transportation stations, and within 15 feet of playgrounds

• Exempts private residences (except child care/health care facilities), tobacco retail outlets, and outdoor employment areas; establishes penalties including fines ($50 first violation, $100 second, $500 third within one year), license suspension/revocation, and allows employees and private citizens to bring enforcement lawsuits
