HB 1716 Summary

• Repeals and replaces existing indoor clean air act sections with the "Missouri Indoor Clean Air Act," establishing comprehensive statewide smoking prohibitions effective January 1, 2015.

• Prohibits smoking in all enclosed public places including bars, restaurants, health care facilities, educational facilities, gaming facilities, hotels and motels (at least 80% of rooms), and public transportation vehicles and facilities.

• Prohibits smoking in all enclosed workplace facilities without exception, including work areas, offices, elevators, restrooms, and vehicles, with notification requirements to employees by January 1, 2015.

• Prohibits smoking outdoors within 15 feet of entrances and ventilation systems, in outdoor arenas and stadiums, at public transportation stations, and in/near playgrounds.

• Establishes violations as infractions for individuals smoking in prohibited areas; owners/operators face escalating fines ($50 for first violation, $100 for second within one year, $500 for subsequent violations) and possible license suspension or revocation, with private citizens and employees able to bring enforcement actions.
