HB 1867 Summary

• Repeals and replaces 21 sections of Missouri law regarding underground facility safety and notification procedures for excavation activities.

• Requires all underground facility owners to participate in a statewide notification center and eliminates previous county-classification-based phase-in requirements for mandatory participation.

• Modifies excavation notice procedures to require 2-10 working days advance notice to notification center, with owners required to mark facilities or respond within 2 working days, and establishes "no response" procedures allowing excavation after 2 hours if facility owner fails to respond.

• Adds new requirements for sewer system owners to provide information about sewer service connections during trenchless excavation and requires tracer wire installation on new water/sewer laterals in public rights-of-way by January 1, 2016.

• Establishes civil penalties up to $10,000 per day per violation (capped at $500,000 for related violations) and creates arbitration option for disputes under $5,000; repeals sections governing railroad utility crossings (sections 389.585-389.591).
