HB 1917 Summary

• Establishes the "Competitive Energy for Missouri Jobs Act" requiring the Missouri Public Service Commission to create a transparent request for proposals (RFP) process for electrical corporations acquiring or constructing supply-side resources of five megawatts or more with contracted terms of eighteen months or longer by August 28, 2015.

• Requires each electrical corporation to file a resource plan with the commission every three years and issue an RFP if the plan includes acquiring or constructing supply-side resources, with RFPs specifying capacity, fuel type, cost estimates, in-service date, and price and non-price attributes.

• Mandates that an independent evaluator selected through a separate RFP process conduct all RFP bid evaluations, with the evaluator maintaining confidentiality of proprietary information, developing transparent evaluation procedures, and establishing dispute resolution mechanisms.

• Presumes reasonable and prudent all costs incurred by electrical corporations in the RFP process and resource acquisition, except when the commission finds imprudence in process compliance, failure to ensure competitive bidding, or when self-build costs exceed the utility's original RFP bid proposal.

• Authorizes the Commission to promulgate rules implementing the Act's provisions, subject to the requirements and review procedures of Missouri's Administrative Procedure Act (Chapter 536).
