Prohibits state agencies, departments, and political subdivisions from conducting biometric analysis on photographic or digital data or retaining biometric data of individuals, with limited exceptions.

Allows colleges and universities to conduct biometric analysis for academic purposes with the subject's consent.

Permits retention of biometric data related to open investigations, pending criminal cases, and convicted criminals; allows law enforcement and highway patrol to conduct fingerprint background checks.

Authorizes collection and use of biometric data for individuals in state custody, persons of interest in law enforcement investigations, and public assistance identification purposes.

Establishes criminal penalties: class A misdemeanor for violations, class D felony for illegal sharing or access of biometric data, and class C felony for batch processing of multiple individuals' illegally retained biometric data.
