HB 1941 Summary

• Expands nuisance action standing to allow individual property owners within reasonable distance to sue for property damage, in addition to neighborhood organizations, in specified cities and counties.

• Adds attorney's fees and expenses as recoverable damages when property owners or neighborhood organizations prevail in nuisance actions, with judgments filed becoming liens against the offending property.

• Modifies notice requirements for neighborhood organizations bringing nuisance actions to include certified mail to both tenants and property owners, with alternative posting methods if certified mail is unsuccessful.

• Restricts neighborhood organization actions against residential rental properties when a city citation is pending on the same code violation, unless the citation has been unresolved for more than 45 days.

• Applies nuisance provisions to cities not within a county and home rule cities with more than 400,000 inhabitants located in more than one county.
