Requires all employees and volunteers at health care facilities inspected by the Department of Health and Senior Services to receive annual influenza vaccination within three months prior to flu season as defined by the Centers for Disease Control and Prevention.

Permits exemptions for medical contraindications (with physician documentation), religious beliefs (with written signed request), or vaccine shortage (with written documentation of inability to obtain vaccine).

Facilities must maintain vaccination proof or exemption documentation in personnel files and are deemed non-compliant if fewer than 95 percent of inspected personnel files contain proper documentation.

Non-compliant facilities receive an unannounced reinspection within three months; if still non-compliant at reinspection, facilities are fined $50 per full-time employee.

Provisions automatically sunset six years after the effective date unless reauthorized by the General Assembly; the Department of Health and Senior Services shall promulgate administrative rules.
