Repeals and replaces section 167.131 regarding school transfers, adding provisions for students in unaccredited districts to transfer to accredited districts in the same or adjoining counties with tuition and transportation paid by the sending district.

Students from unaccredited districts may transfer if they were enrolled during the year the district was declared unaccredited, enrolled in subsequent years, or become eligible for kindergarten or first grade after the effective date.

Receiving districts must establish admission criteria by June 30, 2014, based primarily on availability of highly qualified teachers and classroom space, with preference given to siblings of already-enrolled transfer students if capacity is insufficient.

Transfer students' performance shall not be included in the receiving district's annual performance reports until the student has attended for three full academic years.

Once an unaccredited district regains accreditation, transfer students must return to their residence district at the beginning of the next school year; declared an emergency act effective upon passage and approval.
