• Creates a Partnership for Public Facilities and Infrastructure Advisory Commission with 11 members (legislative, state officials) to review and advise on proposed partnerships costing $3 million or more for state-funded entities.

• Requires responsible public entities to adopt public guidelines governing project selection, competitive procurement methods (sealed bidding, competitive negotiation, or reverse auctions for commodities), and financial review procedures before considering proposals.

• Allows private entities to request approval or public entities to solicit proposals for qualifying projects; establishes procedures for interim and comprehensive agreements, including bonds, insurance, maintenance requirements, and user fee structures.

• Adds protections for confidential information including trade secrets and financial records of private entities under section 610.021 and establishes criminal penalties (fines up to $500 or twice contribution amount) for improper solicitation of contributions from bidders on contracts valued at $5 million or more.
