• Repeals and replaces Section 288.034, RSMo, which defines "employment" under Missouri's employment security law.

• Redefines employment to include service performed for wages under any contract of hire, and incorporates federal unemployment tax law standards to determine coverage.

• Establishes that employment includes services localized in Missouri or performed both within and outside the state where the base of operations or control is located in Missouri, or where the individual resides in Missouri.

• Applies the common law "right to control" test to determine independent contractor status, specifying that if an employer retains control over the manner and means of work, the individual is an employee; if only results are controlled, the individual is an independent contractor.

• Maintains existing exemptions for agricultural labor, domestic service, newspaper delivery by minors, family employment, certain educational institutions, religious organizations, and various other categories of service.
