Modifies the exemption for unlicensed family child care to require that related children are only excluded from the child count if the caregiver is also caring for at least two unrelated children for payment, and excludes children eligible for public kindergarten or elementary school from the count.

Requires all child care facilities (licensed and unlicensed) to disclose their licensure status to parents or guardians and prohibits unlicensed facilities from misrepresenting themselves as licensed.

Changes penalties for violations from an infraction with a fine not to exceed $200 to a Class A misdemeanor with fines up to $200 per day, not to exceed $10,000 total for subsequent offenses.

Grants the Department of Health and Senior Services authority to immediately close any illegally operating unlicensed child care facility upon documentation of illegal status or finding of emergency harm to children.

Allows the prosecuting attorney to file suit for a permanent order preventing operation of illegal unlicensed facilities, with the order remaining in effect until the facility complies with all licensure requirements.
