Repeals and reenacts section 191.905, RSMo, relating to public benefits fraud involving health care providers and health care payments.

Prohibits health care providers from knowingly making false statements about medical necessity, concealing events affecting eligibility, withholding information to obtain improper payments, or misrepresenting the value of health care provided.

Prohibits persons from soliciting or receiving kickbacks, bribes, or rebates in connection with health care referrals or purchasing decisions, and prohibits offering such remuneration to induce referrals or purchasing.

Establishes criminal penalties of class C felony for first violations and class B felony for subsequent violations of fraud provisions; establishes civil penalties of $5,000-$10,000 per violation plus 2-3 times actual damages sustained by state and federal governments.

Establishes the MO HealthNet Fraud Reimbursement Fund and MO HealthNet Fraud Prosecution Revolving Fund to receive restitution and prosecution cost reimbursements; exempts Medicaid fraud actions from the two-year statute of limitations under section 516.390.
