State Board of Education appoints the Commissioner of Education as its chief administrative officer with educational attainment and public education administration experience required.

Senate may remove the Commissioner of Education by adopting a resolution with a two-thirds vote of its members.

Commissioners removed by the Senate cannot be reappointed by the State Board of Education unless the Senate adopts a resolution by two-thirds vote to allow reappointment.

State Board of Education retains authority to remove the Commissioner at its discretion and continues to prescribe duties and fix compensation.

The bill becomes effective only upon passage of a constitutional amendment to Missouri Constitution Article IX, Section 2(b) to authorize Senate removal of the Commissioner of Education.
