The division shall develop and maintain a workers' compensation claims database accessible to potential employers through the division's website containing all claims filed under Chapter 287.

Employers may retrieve claims records only after obtaining written consent from a potential employee during the pre-hire period and providing the employee's name and social security number.

Retrieved records shall identify the date of any claim made by the potential employee and whether the claim is open or closed.

Employers are prohibited from compelling, coercing, or requiring a potential employee to provide written consent to acquire claims records as a condition of employment.

Fraudulent database access, compelling consent, or requiring consent as a condition of employment constitutes a class A misdemeanor; the division must fully implement these provisions by July 1, 2015.
