SB 549 Summary

• Creates offense of "failing to stop the illegal possession of a weapon" for parents or guardians who know a child under 18 possesses a weapon in violation of chapter 571 and fail to make reasonable efforts to stop or report it; punishable as a class A misdemeanor or class D felony if the child causes injury or death.

• Creates offense of "negligent storage of a weapon" for parents or guardians who recklessly store a weapon in a manner a child under 18 is likely to access, resulting in the child carrying the weapon onto a school bus, using it during a crime, or causing injury or death; punishable as a class A misdemeanor or class D felony, with an additional $1,000 fine if the parent failed to notify the school of weapon ownership.

• Provides three safe storage exceptions: weapons stored in a securely locked container, equipped with a cable lock or trigger lock, or kept on the person's body or in close proximity.

• Requires parents or guardians to notify, in writing, their child's school district or school within 30 days of enrolling the child or purchasing a weapon; notification must include names of parent and child but not weapon type or quantity.

• Makes failure to notify a school of weapon ownership an infraction punishable by a fine of up to $100.
