State Board of Education cannot assign "unaccredited" classification or downgrade districts from "accredited" to "provisionally accredited" unless a state board member resides in that congressional district.

Unaccredited school districts must pay tuition and provide transportation for resident students to attend accredited schools in the same or adjoining county, with tuition rates based on per-pupil cost of the receiving district's grade level grouping.

Accredited districts may establish class size and student-teacher ratio policies to limit transfers from unaccredited districts, subject to state board review for undue restrictiveness and appeal rights.

Accredited districts must report available enrollment slots by grade level to the Department of Elementary and Secondary Education and publish this information on their websites by January 1 annually.

Unaccredited or provisionally accredited districts are ineligible to receive transfer students, and the act takes effect immediately as an emergency measure.
