Federal agents or state law enforcement may petition a circuit judge with an affidavit detailing reasonable suspicion of a conflict of interest to obtain a waiver; if granted, the judge designates a substitute for the sheriff.

The sheriff or designee must check the warrant and process to protect the rights of affected persons and make a complete and permanent report on the incident.

Serving a federal or state warrant without meeting these conditions is a class A misdemeanor.
