SCS SB 875 Summary

• Repeals and replaces section 208.080, RSMo, regarding public assistance administrative appeals procedures for the Division of Family Services.

• Recipients have 10 days from notice of proposed benefit/service reduction, modification, or discontinuation to request an appeal to the director, during which time benefits continue undiminished unless the recipient requests otherwise in aid to families with dependent children cases.

• Recipients have 90 days from case closure or modification to request an appeal if no prior appeal was requested, and must be notified of appeal rights "before adverse action is taken" rather than "at the time of" the action.

• Applicants rejected for benefits or services have 90 days from notice of rejection to request an appeal and must be provided proper blank appeal forms by the county office.

• Appeal hearings are conducted by the director or designee, with applicants/recipients entitled to be present in person with legal representation and present evidence; the director must document findings of fact and conclusions of law in decisions.
