Repeals and re-enacts section 64.170, RSMo, relating to county authority to establish building codes and residential occupancy standards.

Maintains existing authority for first and second classification counties to adopt building codes for construction, reconstruction, alteration, and repair of buildings and structures, subject to voter approval if the code was not adopted prior to August 28, 2001.

Requires that building code proposals be voted on only by voters in the affected area, excluding citizens of incorporated territories from voting on county-wide codes.

Grants county commissions in first classification counties with more than 150,000 but fewer than 200,000 inhabitants authority to adopt regulations establishing minimum occupancy standards for residential units intended for rent or lease.

Allows qualifying counties to develop licensing and inspection programs for rental residential units and to establish reasonable fees to recover administrative costs.
