Repeals and replaces sections 104.380 and 104.1039, RSMo, and creates new section 104.037 relating to creditable service calculations for rehired retired state employees.

Allows retired members of the Missouri Department of Transportation and Highway Patrol Employees' Retirement System or Missouri State Employees' Retirement System who are elected or appointed to state office, or reemployed by a department to be treated as active members if they reimburse the retirement system for all retirement benefits received.

Members who reimburse the system and later retire shall have their creditable service calculated as if they never retired, allowing them to combine their prior service with new service accrued.

Retired members reemployed in positions requiring at least 1,040 hours per year without reimbursement are treated as new employees with no previous service credit and must accrue service continuously for one year before receiving any additional annuity.

Annual benefit increases and cost-of-living adjustments do not accrue during reemployment; future increases resume in the same month as original annual increases were paid.
