Missouri Department of Health and Senior Services must establish life safety code standards for licensed hospitals that exclusively match federal Medicare program standards under 42 CFR Part 482 (hospitals) and 42 CFR Part 485 (critical access hospitals)

Department may waive specific life safety code standards if compliance would cause unreasonable hardship for a facility and patient health and safety would not be compromised

State authority to establish and enforce hospital licensure regulations conflicting with the new federal-aligned life safety code standards lapses on January 1, 2017

Hospital licensure regulations may incorporate by reference later amendments to federal rules, regulations, standards, or guidelines to maintain current safety and practice standards—an exception to the general rule prohibiting automatic incorporation of future amendments

Rules created under this section are void if General Assembly's powers to review, delay, or annul administrative rules are held unconstitutional
