Districts cannot determine a child is gifted based solely on participation in Advanced Placement or International Baccalaureate courses; students must meet the statutory definition of "gifted children" under section 162.675

Beginning in the 2016-2017 school year, districts experiencing a 20% or greater decrease in gifted program enrollment from the previous year face a financial penalty of $680 multiplied by the difference in enrolled students, subtracted from state aid payments

Removes the previous provision that penalized districts for gifted enrollment decreases exceeding 20% from 2005-06 levels, replacing it with a year-over-year comparison

Section 163.031 provisions take effect July 1, 2016
