MO HealthNet participants must pay an $8 co-payment when using hospital emergency departments for non-emergency medical conditions, effective October 1, 2015

Participants must be notified of the $8 co-payment before services are rendered

"Emergency medical condition" is defined as acute symptoms severe enough that a prudent layperson would reasonably expect lack of immediate care could place health in serious jeopardy, cause serious bodily impairment, or serious organ dysfunction

Department of Social Services must promulgate rules for implementation, including required physician documentation and informed consent to be signed by participant's parent or guardian

Rules must comply with Chapter 536 administrative procedures; if General Assembly's rule review powers are held unconstitutional, any rules adopted after August 28, 2015 become invalid and void
