The nuclear energy standard takes effect only after a Missouri-based SMR production facility has manufactured at least three reactors that are legally available for sale or use

Utilities must comply with the 2% requirement no less than three years after the production facility becomes operational, with the Public Service Commission setting the specific timeline

Utilities may petition the commission for an exemption to meet the 2% requirement through renewable, hydroelectric, or renewable energy credits instead, if they demonstrate undue hardship or lack of increased energy demand

SMR production facilities may receive up to $150 million annually in state job creation, worker training, and infrastructure development program benefits, with these amounts excluded from aggregate caps on such programs
