Establishes statutory definitions for water-related terms including accretion, avulsion, low water mark, navigable and nonnavigable watercourses, riparian owner, thalweg, and thread

Codifies riparian owner rights including title to the low water mark of navigable watercourses, title to the thread of nonnavigable watercourses, and right of access to water from their frontage

Creates a defense to private nuisance actions for defendants who demonstrate compliance with orders or permits from the Department of Natural Resources, EPA, Army Corps of Engineers, or Attorney General's office (excluding subsurface smoldering events in counties with over 950,000 inhabitants)

Removes the Clean Water Commission's authority to approve stream or wetland mitigation used in connection with Section 401 water quality certifications

Prohibits state agencies from creating, purchasing, participating in, or requiring acquisition of any credit, mitigation credit, or offset credit as a condition of permit issuance, extension, or termination
