Establishes a priority system for distributing state public funds for family planning services through the Department of Health and Senior Services, with state/political subdivision-owned facilities receiving first priority, followed by nonpublic hospitals and federally qualified health centers, then rural health clinics, and finally nonpublic primary health care providers

Defines "public funds" broadly to include state general revenue, special accounts, limited purpose grants or loans, and federal funds under Title V, Title XIX, and Title XX of the Social Security Act

Authorizes prosecuting attorneys or the attorney general to bring legal action for recoupment or injunctive relief against anyone who intentionally violates the funding priority requirements

Grants standing to any entity eligible for public funds to sue if funding violations resulted in reduced funds available to that entity, with recouped monies reverting to the original fund source

Provides for reasonable attorney's fees to be awarded to the prevailing party, with fees awarded against plaintiffs only if the court finds the suit was frivolous and brought in bad faith
