Redefines "qualified spousal trust" to require settlors be "married to each other" rather than "husband and wife" at the time of trust creation

Grants property held in qualified spousal trusts the same creditor protection as tenants by entirety property, regardless of how the property was titled before transfer to the trust

Removes creditor immunity protection upon dissolution of the settlors' marriage by a court

Preserves each spouse's marital property rights in trust assets during divorce proceedings unless both settlors expressly agree otherwise in writing

Adds new section 456.1-113 establishing that any asset transfer to a trust, trustee, or trust share subjects that asset to the trust's terms if the transfer reasonably identifies the trust
