Proposes a constitutional amendment to Article I of the Missouri Constitution creating Section 22(c) to cap punitive damages at the greater of $500,000 or five times the net judgment amount awarded to the plaintiff

Preserves the right to have punitive damages determined by a jury while imposing the monetary cap on awards

Applies the punitive damages cap to both judge-tried and jury-tried cases

Exempts cases from the cap where the defendant pleads guilty to or is convicted of a felony arising from the acts or omissions alleged by the plaintiff

Would be submitted to Missouri voters at the November 2016 general election or a special election called by the governor, with no expected fiscal impact to the state
