Maximum total penalty for any related series of violations remains capped at $500,000

Violations covered include damage to underground facilities and noncompliance with sections 319.022, 319.025, 319.026, 319.030, and 319.037 of Missouri law

Attorney general or prosecuting attorney may bring civil actions to recover penalties in circuit court

Courts must consider factors including gravity of violation, degree of culpability, prior violations, willfulness, good faith compliance efforts, and ability to pay when determining penalty amounts
