Department of Health and Senior Services must promulgate hospital construction and renovation regulations based exclusively on federal Medicare life safety code standards and the Facility Guidelines Institute 2014 Guidelines for Design and Construction of Health Care Facilities

Department may waive enforcement of these standards if compliance would cause unreasonable hardship and patient health/safety would not be compromised

Existing department hospital licensure regulations that conflict with the new standards shall lapse on January 1, 2018

Hospital licensure regulations may incorporate by reference later amendments to federal rules and guidelines to maintain current safety standards, unlike other state agency rules which cannot include later amendments

Rules created under this section must comply with chapter 536 administrative procedures, and rulemaking authority becomes invalid if General Assembly's powers to review or disapprove rules are held unconstitutional
