Prevents claimants from recovering property damage amounts from defendants that have already been reimbursed to the claimant's insurer, eliminating duplicative recoveries in tort cases

Applies when a defendant or their insurer reimburses a claimant's insurer for deductibles or property damage payments prior to filing a civil action

Preserves insurers' lawful subrogation rights under existing law

Allows any party to present evidence of reimbursement payments in court, notwithstanding section 490.715

Requires such payments to be credited as an offset against any compensable judgment in civil property damage actions
