Children born alive during or after an abortion receive the same legal rights, privileges, and immunities as any other liveborn child in Missouri

Health care providers present must exercise the same degree of professional skill and care to preserve the child's life as they would for any other child born at the same gestational age, and must immediately transport the child to a hospital

Failure to report a violation carries penalties of up to 5 years imprisonment and/or fines between $2,500 and $10,000; knowingly killing a child born alive constitutes first degree murder

Civil liability extends to anyone who causes death or injury to a child born alive, performs unlawful abortions, supplies abortion-inducing substances, or incites others to obtain unlawful abortions

Wrongful death lawsuits may be brought by spouse, partner, parents, siblings, or children of the deceased, with recoverable damages including loss of future fertility, loss of companionship, and attorney's fees; consent to abortion cannot be used as a defense
