Courts may sentence offenders convicted of aggravated sexual offenses against victims under 13 years old to surgical castration, in addition to other sentences, for offenses occurring on or after August 28, 2026

A court-appointed medical expert must determine within 60 days of sentencing whether the offender is an appropriate surgical candidate

For incarcerated offenders, the procedure must be performed no later than one week before release from the correctional facility

Offenders who fail to appear or refuse the procedure face 3-5 years imprisonment without probation, parole, or suspended sentence

The provision does not apply to offenders under 17 years old or cases where castration is not medically appropriate
