School districts with 3% or more students identified as gifted must establish a state-approved gifted program starting in the 2024-25 school year

Beginning in 2027-28, all school districts must provide universal screenings for gifted students at least once before grade three, using evidence from a minimum of two areas such as mental ability testing, academic achievement, creativity, or reasoning

Teachers providing gifted services in districts with more than 350 average daily attendance must be certified in gifted education; smaller districts require teachers to complete at least 6 hours of annual professional development instead

Starting in 2026-27, all districts must adopt board-approved policies establishing processes for universal screening, annual parent notification, student identification criteria, and procedures for parents to request review of decisions

School districts and employees receive immunity from liability for decisions that a child did not qualify for gifted program services
