Private schools serving prekindergarten through grade 12 may designate multiple-occupancy restrooms, locker rooms, and changing areas for exclusive use by male or female sex, as defined by original birth certificate

Exceptions allow individuals to enter opposite-sex facilities for custodial/maintenance purposes, emergency medical assistance, or parents accompanying children age 8 or younger with school permission

Political subdivisions are prohibited from adopting ordinances that prevent private schools from establishing sex-designated restroom policies

Political subdivisions that violate this prohibition must pay the private school's attorney's fees and legal defense costs

Includes an emergency clause for immediate effect upon passage to allow schools to prepare for the 2026-27 school year
