Property owners or their contractors may enter up to 10 feet onto adjoining property to construct, maintain, or repair a division fence for animal enclosures without being guilty of trespass

Owners and contractors remain liable for any damages caused by entry onto adjoining property, including crop damage

No liability applies for clearing or removing trees, brush, or vegetation that lies directly on the property boundary line where the fence is being built

Exemptions apply when adjoining property is owned by utility companies, railroads, zoological parks, wildlife conservation facilities, or AZA-accredited animal sanctuaries

Adjoining property owners owe no duty of care to warn fence builders about hazardous conditions on their property (except as provided in section 537.351)
