Referral agencies that connect prospective residents with independent living facilities or long-term care facilities must provide written documentation of service agreements and disclose any financial relationships with facilities, fees received, and how resident information may be shared with third parties

Prospective residents have the right to terminate referral agency services at any time without fee or penalty, request not to be contacted in the future, and receive the agency's privacy policy

Facilities must pay referral agencies fees once services are performed (regardless of whether the prospective resident terminates) and cannot sell or transfer prospective residents' contact information without written consent

Referral agencies cannot charge facilities penalties when prospective residents terminate their agreements

Violations carry a civil penalty of up to $500 per violation, enforceable by the attorney general or circuit attorney through civil action or injunction
