Plaintiffs in personal injury, property damage, or wrongful death cases may recover damages even if contributorily negligent, but their total recovery is reduced in proportion to their percentage of fault

Plaintiffs are completely barred from recovering any damages if their negligence or fault is determined to be 51% or more

Triers of fact must determine the total damages, the percentage of fault attributable to each party (including third parties), and the proportional reduction of plaintiff's damages

Multiple defendants are each liable only for their proportional share of total damages based on their individual percentage of fault, eliminating joint and several liability for cases where the plaintiff is barred from recovery

Applies to causes of action accruing on or after August 28, 2026
