Missouri Board of Pharmacy gains authority to waive state pharmacy rules and regulations for Missouri-based licensed pharmacies dispensing or shipping prescription drugs to other states or U.S. territories experiencing declared disasters or emergencies.

Disaster period begins 10 days before a governor's proclamation or presidential declaration and extends 60 calendar days after the emergency ends, with the governor able to extend as warranted.

Pharmacies must be licensed and in good standing, authorized to ship to the affected state/territory, comply with that jurisdiction's emergency pharmacy rules, and follow all applicable federal laws.

Waivers apply only to prescription drugs dispensed, shipped, or delivered to residents or health care facilities within the geographic area specified in the disaster declaration.

Board of Pharmacy may promulgate rules to implement these provisions, with any rules adopted after August 28, 2026, subject to standard legislative review procedures under Chapter 536.
