Creates a nonprofit Producer Responsibility Organization by June 1, 2028, funded by producer responsibility dues that vary by material type and recyclability, with dues capped at 5% for administrative costs

Establishes a 13-member advisory board within the Department of Natural Resources to oversee the program, review needs assessments, and approve plan proposals covering 5-year periods

Exempts producers with less than $5 million in annual gross revenue, those using less than one ton of covered materials annually, nonprofits, state/local governments, and certain agricultural employers and retail food establishments

Imposes administrative penalties for violations ranging from $5,000 for first offenses up to $20,000 for third or subsequent violations, plus daily penalties of $1,500 to $6,000 for continuing violations
