Removes the requirement that courts first consider non-monetary conditions before imposing cash bail, giving judges broader discretion to set monetary or non-monetary release conditions as they determine appropriate

Requires courts to give "substantial weight" to four factors when setting release conditions: prior criminal convictions/history, prior failures to appear in court, nature and seriousness of the current charge, and known risks to community or individual safety

Establishes that court discretion in setting release conditions is presumed valid and cannot be overturned on appeal absent a "clear abuse of discretion"

Eliminates the prohibition on setting bail amounts higher than necessary to secure appearance and protect safety, removing the prior requirement to consider defendant's ability to pay before setting monetary conditions

Takes effect January 1, 2027
