Repeals existing law that allowed local political subdivisions to enact more stringent tobacco ordinances than state law

Local governments may still enforce ordinances setting the minimum age to sell or purchase tobacco and nicotine products at 21 years old

Local tobacco regulations in effect as of January 1, 2026 are grandfathered and exempt from state preemption

Any local tobacco ordinance enacted or amended after January 1, 2026 becomes subject to state preemption
