Repeals existing second-degree murder statute for killing a child aborted alive and replaces it with the "Born-Alive Abortion Survivors Protection Act"

Grants children born alive during or after an abortion all rights, privileges, and immunities of other Missouri residents and liveborn children

Requires health care providers present at such births to exercise the same standard of care as for any other child born at the same gestational age, including determining resuscitation or palliative care and arranging hospital transport if necessary

Establishes civil liability for knowingly, recklessly, or negligently causing the death of a child born alive during an abortion, failing to comply with care requirements, performing unlawful abortions, or aiding/abetting self-induced or unlawful abortions

Allows wrongful death and personal injury lawsuits by spouses, partners, parents, and children, with recoverable damages including loss of fertility and companionship, plus mandatory attorney's fees for prevailing plaintiffs; bars assumption of risk and consent as defenses
