Homeowners' associations must automatically dissolve 10 years after establishment unless renewed by an 85% majority vote of all members in an election held within 90 days of the dissolution date

Associations that fail to achieve the 85% renewal threshold are immediately dissolved, and homeowners cannot be subjected to a new association for 10 years unless 85% approve

Renewed associations must undergo the same 85% member vote renewal process every 10 years

Existing associations that have been operating for at least 10 years as of August 28, 2026, must hold a renewal election by December 31, 2026, and every 10 years thereafter

Condominium unit owners' associations and residential cooperatives are excluded from these requirements
