Creates the "Missouri Entrepreneurial Freedom Restoration Act" establishing the right to earn a living as a fundamental right protected from arbitrary government interference

Requires government to prove by clear and convincing evidence that any restriction on earning a living is necessary to protect public health, safety, or welfare and is the least restrictive means available

Prohibits economic protectionism as a valid justification for occupational restrictions; defines "welfare" narrowly to exclude protection of businesses against competition

Allows individuals to sue state and local governments for violations, with courts authorized to award declaratory relief, injunctions, nominal damages up to $1, and reasonable attorney fees

Waives sovereign immunity and qualified immunity for nominal damages claims against government officials who unlawfully burden the right to earn a living
