Private schools serving prekindergarten through grade 12 may designate multiple-occupancy restrooms, locker rooms, and changing areas for exclusive use by male or female students based on sex as identified on original birth certificates.

Exceptions allow individuals to enter opposite-sex facilities for custodial/maintenance purposes, emergency medical assistance, or parents/guardians accompanying children age 8 or younger with school permission.

Political subdivisions are prohibited from adopting ordinances, rules, or regulations that would prevent private schools from establishing sex-designated facilities.

Political subdivisions that violate this prohibition must pay the attorney's fees and legal costs incurred by private schools defending against such local rules.

Includes an emergency clause for immediate effect upon passage to protect private schools from liability and allow preparation for the 2026-27 school year.
