Gag clauses prevent disclosure of price or quality information, negotiated rates, or out-of-pocket costs to enrollees, government entities, or plan sponsors

Most-favored-nation clauses prohibit providers from offering lower rates to other insurers or require matching rates across contracts

Any prohibited clause in a provider network contract is void and unenforceable, while remaining contract provisions stay in effect
