Health carriers must provide coverage without cost-sharing for preventive services rated A or B by the U.S. Preventive Services Task Force, CDC-recommended immunizations, and HRSA-supported preventive care screenings, effective January 1, 2026.

Out-of-network providers may still be subject to cost-sharing requirements, and high deductible health plans may apply deductibles unless the service qualifies under IRS safe harbor provisions for preventive care.

The Director of the Department of Commerce and Insurance must enforce requirements based on federal guidelines in effect as of December 31, 2025, and adopt rules for any new recommendations issued after that date.

A five-member "Health Insurance Preventive Health Care Services Advisory Committee" will be created, consisting of three healthcare provider representatives and two health carrier representatives, to make annual recommendations by November 1st.

Rules adopted under this section must comply with Chapter 536 administrative procedures, with any rules proposed after August 28, 2026 becoming void if the General Assembly's rulemaking review powers are held unconstitutional.
