Amends Section 71-3-71 of the Mississippi Code to require reduction of an employer's or insurer's recovery from third-party damage settlements based on the employer's percentage of fault in the injury or death.

When an injured employee recovers damages from a third party, the employer/insurer's reimbursement from those proceeds must be reduced by an amount proportional to the employer's percentage of fault.

Applies the same fault-based reduction when an employer/insurer maintains its own action against a third party responsible for employee injury or death.

Takes effect July 1, 2010.
