MS HB1400

Amends Section 93-13-211 of the Mississippi Code to revise the threshold for distributing money and property to wards from an unspecified amount to twenty-five thousand dollars ($25,000.00).

Requires chancery courts to fully investigate settlements of ward claims (arising from contract or tort) and confirm the proposed payment represents a fair settlement and serves the ward's best interest before authorizing distribution.

Allows chancery courts to authorize acceptance of money or personal property settlements by wards without requiring the recipient to post security unless the court specifically orders otherwise.

Applies to distributions from court judgments, decrees, or other sources to wards or persons under disability in the county of residence or where the money or property is located.

Takes effect July 1, 2010.
